Developing legislation on counter-terrorism
This past week, the Law Commission commenced the process of developing legislation on counter-terrorism. This process was initiated in response to the gaps identified in Malawi’s legislative, technical, and institutional frameworks concerning counter-terrorism. Currently, Malawi does not have a dedicated and comprehensive law on terrorism, aside from a few offences that were added to the Penal Code in 2023.
The law reform process will lead to the development of comprehensive counter-terrorism legislation that will domesticate applicable international instruments; align with the Constitution and international best practices; and establish an institutional framework to address counter-terrorism, including international cooperation and collaboration on such matters.
The Law Commission is receiving technical and financial support from the Government of Malawi and the EU-UN Global Terrorism Threats Facility for this undertaking.
